Consumer Rights – Withdrawal – Cancellation Return Conditions
GENERAL:
1.If you place an order electronically through the website you are using, you are considered to have accepted the pre-informed form and the distance sales contract provided to you.
2.Buyers are subject to the provisions of the Law on the Protection of the Consumer No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchased.
3.Shipping costs, which are the product shipment expenses, will be paid by the buyers.
4.Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer within the legal period of 30 days, provided that it does not exceed. If the product is not delivered within this period, buyers may terminate the contract.
5.The purchased product must be delivered complete and in accordance with the specifications specified in the order, and if available, with documents such as warranty certificate and user manual.
6.In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer in writing of this situation within 3 days from the date of learning about it. The total amount must be refunded to the buyer within 14 days.
If the purchased product price is not paid:
7.If the buyer does not pay the price of the purchased product or cancels it in the bank records, the seller’s obligation to deliver the product ends.
UNAUTHORIZED USE OF THE CREDIT CARD FOR SHOPPING:
8.If it is determined that the credit card used for payment by the buyer has been unlawfully used by unauthorized persons after the product is delivered, and if the price of the sold product is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days at the expense of the seller.
IF THE PRODUCT CANNOT BE DELIVERED WITHIN THE EXPECTED TIME DUE TO UNFORESEEN REASONS:
9.If unforeseeable force majeure events occur that the Seller cannot foresee and the product cannot be delivered within the specified time, the situation is notified to the Buyer. The Buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the Buyer cancels the order; if the payment is made in cash, the amount is refunded to the Buyer in cash within 14 days from the cancellation. If the Buyer has made the payment by credit card and cancels it, the product price will be refunded to the bank within 14 days from the cancellation, but it is possible that the bank will transfer it to the Buyer’s account within 2-3 weeks.
BUYER’S OBLIGATION TO INSPECT THE PRODUCT:
10.The buyer will inspect the goods/services subject to the contract before accepting them; damaged, broken, torn packaging, etc. The buyer will not accept damaged and defective goods/services from the shipping company. The delivered goods/services will be deemed undamaged and sound. The BUYER must carefully protect the goods/services after delivery. If the right of withdrawal will be used, the goods/services should not be used. The invoice should also be returned with the product.
RIGHT OF WITHDRAWAL:
11.The BUYER may exercise the right of withdrawal from the contract without any legal or criminal liability and without giving any reason by rejecting the goods within 14 (fourteen) days from the date of delivery of the product to him or the person/organization at the address specified by him, provided that he notifies the SELLER via the contact information below.

13.If the buyer has purchased a service, this 14-day period starts from the date the contract is signed. In service contracts where the service performance has started with the consumer’s approval before the expiry of the right of withdrawal, the right of withdrawal cannot be exercised. The notification regarding the right of withdrawal has been provided in the Distance Contracts and Cancellation Conditions, and the Buyer places the order knowingly aware of the Withdrawal conditions.
14.The expenses arising from the exercise of the right of withdrawal are borne by the SELLER.
15.In order to exercise the right of withdrawal, it is necessary to notify the SELLER in writing or by the method notified by the SELLER, such as registered mail, fax, e-mail, within the 14 (fourteen) day period, and the product must not have been used within the scope of the “Products for which the Right of Withdrawal Cannot be Used” provisions stipulated in this agreement.
USE OF THE RIGHT OF WITHDRAWAL:
16.The invoice of the product delivered to the third party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution when returning it. Order returns whose invoice is issued on behalf of the institutions cannot be completed unless the RETURN INVOICE is issued.)
17.Return form: The products to be returned must be delivered complete and undamaged, including their box, packaging and standard accessories, if any.
RETURN CONDITIONS:
18.The SELLER is obliged to return the total price and the documents that put the BUYER in debt to the BUYER within 10 days at the latest after receiving the notice of withdrawal, and to receive the goods back within 20 days.
19.If the value of the goods decreases or the return becomes impossible due to a reason caused by the BUYER’s fault, the BUYER is obliged to compensate the SELLER’s damages in proportion to the fault. However, the BUYER is not responsible for any changes or deteriorations that occur due to the improper use of the goods or product within the right of withdrawal period.
20.If the campaign limit amount set by the SELLER falls below due to the exercise of the right of withdrawal, the discount amount used within the scope of the campaign will be cancelled.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:
21.Underwear bottoms, swimsuits and bikini bottoms, make-up materials, disposable products, goods prepared in line with the BUYER’s request or clearly personal needs and that cannot be sent back, goods that are in danger of rapid deterioration or that may expire, are delivered to the BUYER. Products that are not suitable for health and hygiene to be returned if the packaging is opened by the BUYER after delivery, products that are mixed with other products after delivery and cannot be separated due to their nature, goods related to periodicals such as newspapers and magazines, other than those provided within the scope of the subscription agreement, instant fulfillment in the electronic environment In accordance with the Regulation, it is not possible to return the services provided or intangible goods delivered immediately to the consumer, as well as audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if their packaging has been opened by the BUYER. In addition, it is not possible to exercise the right of withdrawal regarding services that started to be performed with the approval of the consumer before the right of withdrawal expires, in accordance with the Regulation.
22.Cosmetics and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridges, ribbons, etc.) must be returned in unopened, untested, intact packaging. and they must be unused.
23. In accordance with the following distance contracts regulation; Products for which the right of withdrawal cannot be exercised,
- Contracts regarding goods prepared in line with the wishes or personal needs of the consumer.
- Contracts for the delivery of goods that can quickly deteriorate or expire.
- Goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; Contracts regarding the delivery of those whose return is not suitable in terms of health and hygiene.
- Contracts regarding goods that are mixed with other products after delivery and cannot be separated due to their nature.
- Contracts regarding books, digital content and computer consumables offered in tangible form if the protective elements such as packaging, tape, seals and packages have been opened after the delivery of the goods.
- Contracts regarding the use of free time for accommodation, goods transportation, car rental, food and beverage supply and entertainment or recreation, which must be made on a certain date or period.
- Contracts regarding services performed instantly electronically or intangible goods delivered instantly to the consumer.
DEFAULT AND LEGAL CONSEQUENCES
24.BUYER accepts, declares and undertakes that in case of default when making payment transactions by credit card, the card holder will pay interest within the framework of the credit card agreement with the bank and will be responsible to the bank. In this case, the relevant bank may take legal action; may demand the expenses and attorney’s fees that may arise from the BUYER, and in any case, in case of default due to the BUYER’s debt, the BUYER agrees to pay the damages and losses suffered by the SELLER due to the delayed performance of the debt.
